Position Overview

Prepares and maintains case folders on all new civil and abuse/neglect cases filed in the Winnebago Tribal Court. Attends court hearings, arraignments and trails to assist the judge as needed; and records court proceedings.

Specific

Job Duties /Responsibilities:

  • Demonstrates the Winnebago Tribe’s core mission, vision, and values.
  • Answers all inquiries to the Tribal Court offices, both in person and over the telephone. Ascertains nature of business and directs caller to the appropriate staff member for resolution.
  • Assists unrepresented individuals in the process of filing of new civil cases, without providing or attempting to provide legal advice.
  • Prepares case files on all new civil proceedings, schedules hearings, and ensures proper notice of new filings is perfected on all opposing parties.
  • Prepares case files on all new abuse/neglect cases filed by the Presenting Officer, schedules hearings, and ensures proper notice of new filings is perfected.
  • Prepare files for court. All current documentation filed and updated docket sheet.
  • Prepares daily docket of cases to be called.
  • Attends hearing, arraignments and trials, to assist the judge as needed and records minutes of court proceedings.
  • Administers oath to witnesses.
  • Maintains all exhibits and proposed exhibits in each case. Prepares and issues all case related materials, including warrants, subpoenas, summons and hearings notices, as requested by the parties. Responsible for witness management including jury selection and notifications.
  • Prepare and maintain all active/pending case folders in an orderly fashion.
  • Provides copies of all court proceedings to all parties, and provides a certificate of service for the court file to document the date and manner of such notice.
  • Notifies all parties concerned regarding postponements, cancellations, and rescheduling of court activities by telephone, mail, or personal service if time allows.
  • Prepares emergency documents and provides them to judges for review in a manner to ensure the quickest possible time for the judge to respond, even if after hours.
  • Posts, files, and routes all court documents. Prepare orders and documents as needed.
  • Secures information for judges. Contracts witnesses, attorneys, and litigants to obtain information for the court.
  • Maintains logs so that they are current and updated: warrant list, court process log, traffic log, bond log, master file log, and other established logs.
  • Assigns case numbers, maintain court docket and cross reference systems.
  • Records arrangements for payment of court fees. Accepts monetary payments restitution, civil judgments, filing fees, and any other established transaction that may be paid at the court; prepares a receipt for payer.
  • Prepare cases for closure, ensure files are complete.
  • May type or record court transcripts.
  • Takes written complains, petitions, and any other filings; as appropriate. Will attest to and certify court documents.
  • Will notarize signatures on a regular basis.
  • Maintain mast court calendar, make entries as appropriate and keep calendar current.
  • May be required to work after normal business hours, weekends, and holidays to take cash bonds from or for incarcerated individuals, to provide information for police from files or to contact available judge on certain situations. May need to accompany police or probation officer when a prisoner is in route to or from jail.
  • Must be familiar with all areas of the court and filing systems of all case files (forms, different procedures, etc.) to insure case flow and back up when other clerks are out.
  • Answer telephone and greet public in a positive manner. Provides information on cases, as appropriate, without providing legal advice.
  • Receive and distribute all incoming judicial correspondence; screen judicial calls and take messages as required.
  • Know basic tribal finance purchase order and requisition systems. May assist administrator in these areas as necessary.
  • Will maintain confidentiality of all clients records as provided by law.
